Terms of Use.

These Terms of Use ("Terms") govern your use of the Cadence iOS application ("the app", "Cadence"). By downloading, installing, or using Cadence, you agree to these Terms.

1. License

Cadence grants you a personal, non-transferable, non-exclusive, revocable license to install and use the app on iOS devices you own or control, solely for your personal, non-commercial use. This license does not permit you to:

Promotional offers (such as a discounted first year) may be shown to users who decline the standard paywall. Any promotional price applies to the first billing period only; renewals occur at the then-current standard price.

Billing

Payment is charged to your Apple ID at confirmation of purchase. For annual subscriptions with a free trial, you will not be charged until the trial period ends. You may be reminded of upcoming charges by the iOS system before the trial ends.

Auto-renewal

Subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the end of the current period. Renewal is charged to your Apple ID. You can manage or cancel subscriptions in iOS Settings > [your name] > Subscriptions.

Cancellation and refunds

You may cancel your subscription at any time through iOS Settings. Cancellation takes effect at the end of the current billing period; you retain Pro features until that date. Refunds are issued at Apple's sole discretion per their refund policy. To request a refund, visit reportaproblem.apple.com.

Free tier

Core Cadence features (adding tasks, basic Today view, backlog, focus timer, profile) remain available without a subscription. Pro features (Day Flex auto-rebalance, energy-based scheduling, rhythm analytics, journal, gentle notifications) require an active subscription or trial.

3. Your content

Cadence stores the tasks, notes, and answers you enter locally on your device. Because no data is transmitted to our servers, you retain full ownership and control of everything you create in the app. Deleting the app erases this content.

4. Intellectual property

Cadence, its design, name, logo, and all related assets are owned by Adam Kaminski. These Terms grant you no rights to those assets beyond the license in Section 1.

5. Disclaimer of warranties

Cadence is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the app will be uninterrupted, error-free, or free of harmful components. You use Cadence at your own risk.

Cadence is a productivity tool. It is not a medical, psychological, or therapeutic service. It is not a substitute for professional advice or treatment, including for ADHD or any other condition.

6. Limitation of liability

To the maximum extent permitted by law, in no event shall Cadence, its owner, or its contributors be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or in connection with your use of the app. Total aggregate liability shall not exceed the amount you paid for the subscription during the three (3) months preceding the event giving rise to the claim, or twenty United States dollars ($20), whichever is greater.

7. Indemnification

You agree to indemnify and hold Cadence and its owner harmless from any claims, losses, or damages arising from your misuse of the app or violation of these Terms.

8. Termination

We may suspend or terminate your access to Cadence or any Pro features at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. You may terminate at any time by deleting the app and cancelling any active subscription.

9. Governing law

These Terms are governed by the laws of the State of Delaware, United States of America, without regard to its conflict-of-law provisions. Any dispute arising under these Terms shall be resolved in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts.

10. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. Material changes will also be surfaced inside the app. Continued use of Cadence after changes take effect constitutes acceptance of the revised Terms.
